1. Overview

These Terms & Conditions ("Terms") govern your use of the Dr. Olivia Virtual Tutor ("the Service"), an AI-powered educational tool developed by Tiber Health Innovation ("Tiber Health") for Ponce Health Sciences University ("PHSU").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Eligibility & Access

  • The Service is available exclusively to currently enrolled PHSU students, faculty, and authorized staff who have been granted access through their institutional Canvas account.
  • Access is authenticated via PHSU's Canvas Learning Management System. You are responsible for maintaining the confidentiality of your login credentials.
  • Sharing your account credentials or allowing unauthorized individuals to access the Service is prohibited.

3. Purpose & Intended Use

The Service is designed solely as a supplemental educational tool to support your learning. Dr. Olivia is intended to:

  • Help you explore and review medical and health sciences concepts
  • Ask guiding questions that promote deeper thinking and understanding
  • Complement — not replace — your instructors, coursework, and clinical training
Not Medical Advice. The Service does not provide medical advice, diagnosis, or treatment recommendations. Information provided by Dr. Olivia must not be used for clinical decision-making or patient care under any circumstances.

4. Academic Integrity

  • You agree to use the Service in compliance with PHSU's Academic Honor Code and institutional AI Use Policy.
  • The Service must not be used to complete graded assignments, examinations, or any assessed coursework unless explicitly authorized by your instructor.
  • Using the Service to gain an unfair academic advantage may result in disciplinary action as defined by PHSU's academic integrity policies.

5. Accuracy & Limitations

  • Dr. Olivia is powered by artificial intelligence and may generate responses that are incorrect, incomplete, or outdated.
  • You are responsible for critically evaluating all information provided and verifying it against authoritative sources, including textbooks, course materials, and faculty guidance.
  • Tiber Health and PHSU do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

6. Data Collection & Usage

By using the Service, you acknowledge and agree that:

  • Interaction data — including conversation transcripts, session metadata, usage patterns, and learning analytics — is collected and stored to operate, maintain, and improve the Service.
  • Data may be used in anonymized and aggregated form for research, analytics, and product improvement purposes.
  • Session history and conversation summaries are retained to provide you with a personalized learning experience across sessions.
  • Your data is processed in accordance with applicable institutional data governance policies.
Prohibited Content. Do not enter any protected health information (PHI), personally identifiable patient data, or confidential examination content into the Service. The Service is not designed or authorized to process such data.

7. Communication Modes

The Service offers multiple communication styles:

  • Video Interaction — real-time video avatar conversation using your device's camera and microphone
  • Audio Only — voice-based conversation without video
  • Text Chat — text-based conversation interface

By selecting video or audio modes, you consent to the use of your device's camera and/or microphone for the duration of the session. You may switch modes or end your session at any time.

8. Acceptable Use

You agree not to:

  • Use the Service for any purpose other than educational study and review
  • Attempt to manipulate, reverse-engineer, or exploit the AI system
  • Submit abusive, harassing, discriminatory, or inappropriate content
  • Use the Service to generate content that violates any law, regulation, or institutional policy
  • Attempt to circumvent authentication, access controls, or usage limits
  • Record, redistribute, or publicly share session content without authorization

Violation of these terms may result in suspension or revocation of access.

9. Availability & Service Levels

  • The Service is provided on an "as-is" and "as-available" basis.
  • Tiber Health and PHSU reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.
  • Scheduled maintenance and updates may result in temporary service interruptions.
  • Concurrent session capacity may be limited. If capacity is reached, you may be asked to try again later.

10. Intellectual Property

  • The Service, including its design, software, AI models, and content, is the property of Tiber Health Innovation and/or its licensors.
  • PHSU course materials referenced or integrated within the Service remain the intellectual property of PHSU and its respective content owners.
  • You retain ownership of the content you submit during sessions, but grant Tiber Health and PHSU a non-exclusive license to use such content for the purposes described in Section 6.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEITHER TIBER HEALTH NOR PHSU WARRANTS THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TIBER HEALTH INNOVATION NOR PONCE HEALTH SCIENCES UNIVERSITY SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, ACADEMIC OUTCOMES, OR RELIANCE ON AI-GENERATED CONTENT.

13. Modifications to These Terms

Tiber Health reserves the right to update these Terms at any time. Material changes will be communicated through the Service or via institutional channels. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in St. Louis, Missouri.
